The European Commission began regulating electronic nicotine delivery systems as of 19 May 2014, with the Tobacco Products Directive (TPD) becoming applicable to all EU member states as of 20 May 2016. The TPD regulates and oversees all electronic nicotine delivery systems, setting out safety requirements for consumer e-cigarettes, e-cigars and other ENDS.
The main requirements for compliance of TPD Article 20, specifically focused on electronic nicotine delivery systems, includes submission of a technical dossier to relevant authorities, no use of restricted additives with the Article also placing restrictions on advertising and the maximum strength for nicotine-containing liquid.
Through transitional requirements, electronic nicotine delivery systems (ENDS) products and their refill containers could be sold even if not compliant with the TPD up until 20 November 2016 but starting from 20 May 2017, all electronic nicotine delivery system products sold to consumers in the EU must be fully compliant with the TPD.
